A parent died with a loan: who has to pay it?
What happens to a personal loan, home loan or credit card debt when the borrower dies in India, who is liable, and the steps to take with the bank.
The general rule
A loan is a claim on the person’s estate. Heirs are generally liable only up to the value of what they inherit. They are not usually liable to pay from their own income. A co-borrower or guarantor is different: they are liable for the whole amount.
Check for insurance first
Home loans are often bundled with a life cover policy, and some personal loans come with credit life insurance. Ask the bank and look in the papers. A claim may clear the loan.
What to do
- Collect the loan statements and the death certificate.
- Write to the bank to say the borrower has died and ask for the outstanding amount.
- Ask whether any insurance applies.
- Ask for a settlement or a payment plan if the estate cannot cover it.
Recovery calls
Recovery agents must follow RBI rules and cannot harass family. Keep a record of calls and ask for everything in writing. Get legal advice for large amounts or property.
Common questions
Do I have to pay my father’s personal loan?
Generally only from the estate you inherit, unless you are a co-borrower or guarantor.
What about a home loan?
The bank can recover from the property. A co-borrower stays liable.
Will it affect my credit score?
Not unless you are a co-borrower or guarantor.
